Default Tree felling question

I am trying to rid myself of a 75 ft tall dead oak with no branches. The previous owners of this house built the deck around the tree and now it is pressing against the rail. I want to ask a professional advice.

The tree has a clear path to fall. The question is, if I cut the tree 5-7 ft above the rail do you think it could damage the deck?

I dont think it will hit the deck, but if it does are you going to sue me?

If it is as pictured and the tree has a clear path from the 'face' of the stump to the ground is unobsructed by the edge of the deck it should drop right to the ground.
But then again, trees have a funny way of doing things, which is why we are so safety conscious and back up our work with failsafes etc..., so, if the people want a guarantee, Id walk away, or tell them to start disassembling their deck.

make sure it does not hinge over to far before it falls from the stump or it could come back on the railing. Please dont be one of those people that gets knocked off a ladder. atleast send us the video tape if you do.

That's right, shallow angled scarf or notch, you want that top departing with forward momentum and as it's dead with no foliage there will be less wind resistance preventing the top hitting the ground first.

Also dont be gay leaving a real fat hinge, you'd be far smarter doing a strap/bore release on this so you can set up a shit hot thin hinge and let her rip but be out of harms way.
