Default Madison New Jersey shelve tree protection

Seems not all want to protect trees. In this borough the public certainly say NO to tree ordinance.

MADISON – The larger-than-usual crowd that turned out for Monday’s Borough Council meeting to hear a re-introduction of a revised, controversial ordinance to protect trees on private property, didn’t have long to wait.

Shortly after the council heard reports from committees, Councilman John Elias told the public that due to “profound disagreement within the community,” the beleaguered ordinance to protect trees in the borough was being shelved for the present.

EDITOR: Why would the Borough Council continue to pursue to carry a second reading of the Tree Ordinance as early as April 28, or ever, when they have now become aware of a New Jersey Appellate Court decision, which upheld a ruling that invalidated a similar tree ordinance as illegal?

Moreover, why would any member of our governing body in carrying out their fiduciary responsibility support or approve an ordinance similar in terms as the invalidated ordinance prior to a ruling by the New Jersey Supreme Court, which is not expected to be heard until the fall of 2008?

Finally, why was the Borough Council unaware of these issues before they introduced the ordinance on Feb. 28?

Except for certain members of council and the few of special interest groups, most residents do not want a tree ordinance, which imposes regulation on their private property.

The on-line Madison Eagle poll indicated approximately 80 percent of voters against a formal tree ordinance. If that poll is deemed unscientific, then bring the issue to a public vote in the next general election and stop trying to rush and bully through an ordinance that the courts have ruled as illegal and at best extremely controversial.

If the Shade Tree Management Board or the Borough Council truly care about preserving trees in Madison, they should stop trying to pass a private tree ordinance, as every time they introduce the idea we lose dozens of hardwoods throughout the borough. Residents, rather than paying replacement fees or dealing with permit issues, race to remove their trees before an ordinance is approved into law.

Ask any local tree remover, as I have, and they will tell you how busy they were in March removing trees because of the pending tree ordinance.

Council, please do not waste any more time or taxpayer funds to reintroduce this ordinance, as there are many other more important borough matters to attend to. Leave this proposed ordinance on ice, where it justly belongs.

Boroondara Council down here resisted introducing one for several years i believe due to community pressure against it. This is one of the leafiest areas in melbourne too. The residents generally appreciate their mature tree canopy and have the money to maintain them.

We had a big demand for removals leading up to the introduction date.
