This is a long story but to make it real short and sweet it's like this.

Glen Boyle had a lease for The Summerhouse Kiosk in New Farm park, I think it was a 30 year lease.

In September 2000 it burned down.

Nothing has been rebuilt but they did let him operate out of a transportable nearby serving coffees, sandwiches drinks etc but nothing like the 600 meals a day from the old Summerhouse.

Brisbane City Council has fought with Glen for 11 years legally, cost Glen $1million dollars and he lost.

Now the BCC has terminated leases and will soon kick out Glen Boyle. BCC also plan new cafe's to replace him, real nice.

I know there has been arborists involved with this and I know they have either fought against him or for him in court as trees and phelinus noxious were even used as excuses to stop him building.... but they didn't stop BCC from excavating the new playground or dumping their vacuumed soil waste near his old site, nor did BCC removed the dead tree near his site that died from phelinus noxious which is now the fungal condo.

I have attached a court copy of the Appeal and within is the information about arborist issues (page 46 to 51) well worth reading.

Glen had an expert called Dr Galea to discuss phellinus noxious.

Arguing against Dr Galea was arborist Jonathon Hobbs who at or around the time was President of QAA.

We have a lot of information here about phellinus noxious and the fact is that a tree doesn't need a wound to get infected. Clearly Dr Galea had a methodology which would not increase the risk to trees and the court accepted his evidence above Hobb's.

Page 51:-

[241] I accept the evidence of Dr Galea in preference of the evidence of Mr Hobbs. Both of
the experts are well qualified in the field and Mr Hobbs has a long and impressive
record in dealing with arboreal issues. However, Dr Galea I regard as being a qualified
expert specifically in relation to PN. I am satisfied that the proposed development does
not create an additional risk of the spread of PN.

[242] Whilst Dr Galea recommended further investigations rather than a tracing of the root
system of T1, which carries a level of risk, I never the less am satisfied that the risk of
the spread of PN is not a matter alone upon which the court could reasonably justify
refusing the Development Application.

All I see here is a smoke screen that seems to be created by a person with the backing of the above association; they seem to be bedfriends.. with councils up there.

Well it ties in with what I have been saying:-

Two orgs presidents are council workers

Now if you read through that court document between pages 46 to 51 you'll soon notice the attitude of Hobbs. Now considering he is an arborist you'd think he'd come up with solutions not disagreements.

“This will give us sufficient time to conduct an EOI (expression of interest) process to appoint a temporary operator until the ferry terminal kiosk is approved and built,” he said.

Mr Boyle believes rebuilding the Summerhouse is preferable. However, council said a coffee hut would be built in the park itself.

“I think most people agree with me that it (the ferry terminal) is not in the park and New Farm Park needs a facility,” he said.

Mr Boyle said he would use the extra time to gain more signatures to his petition, which already has more than 14,000 supporters.

“I’m pretty confident we could get 20,000 fairly soon,” he said. “Although at times it’s difficult, staring down the barrel of a termination, I’m going to keep providing my service.”
