Default Is this a tree or a weed?

We've had this tree / weed spring up in our backyard - its about 3 or 4 foot high with a thin trunk. The leaves are long and thin - most are light green, some are red or mottled red. Would appreciate any help in identifying it, thanks. We are in the Hunter Valley, NSW.

Mexican Oleander I think.

I've been trying to find some pics of mine, but I seem to have deleted them somehow.

Some useful info is it is a member of the dogbane/Apocynacea family. It is also known by names such as La Adelfa, Rose Laurel, Rosebay, Olean

Oleander is poisonous and can be fatal to humans and animals if ingested. Even the sap is poisonous so wear gloves when pruning. Because of its toxicity Oleander should not be cultivated in gardens with young children.

it isn't the plant that attracts the monarch butterfly, sorry don't know the name of that plant??????
