I live in an association and was just told by the board we have over 30 trees that have to come down some i understand they look like they are roting and will fall over onto some homes but I have a blue spruce that looks healthy and it is located just a couple of feet away from my slab foundation Im not sure what the reason would be other than the roots cracking the cement what questions should I be asking? I really love that tree and don't want it to come down, we are going to protest this unless given good reason to take , these trees down any tree are a thing of beauty laurie

Move...and take the tree with you . You and the tree are too good for that neighborhood.Seriously can't help you out there. Homeowners associations (although they have their place) tend to have rules that become more burdensome than beneficial at times. Maybe hire the services of a professional arborist to assess the tree(s) in question. Generate a report to submit to the council. Could help in your defense. It seems to me that if the tree is healthy and not an eyesore or a hazard they should not be able to make you take it down, since it's obviously been there for awhile and not something you've just recently planted that is against code. SEEK LEGAL ADVICE. Many homeowners assoc. have no specific, implied right require you to do much of anything. Some have a little backbone, but most attempt to reach a little beyond their jurisdiction. Covenants and restrictions not withstanding, a well intended outcome isn't always the best outcome. Do you live in a home you own, or a condo, apt.---differing sets of rules may be applied due to the specific interests of the property owner who has a stake in condo/apt. type situations vs. home ownership in a neighborhood assoc.

Get professional advice -- the tree specialist to assess the trees, the legal advice to use what the tree specialist says, and to find out the powers and reach of the association.
