Default Who's Responsibility

I bought some Chain Saw Bar Guards off a guy on eBay, back in June, and I have not received them yet. I've been in touch with the Seller, and he informed me that I have to file a Claim with the Post Office, about these Bar Guards. Who has to file the Claim, me or him? Thanks. Bruce.

Well, the only way to buy on Ebay is to pay with a CC. That way if you do not get an item, just file the claim with the CC company and they will recover your money. O/w you can file a claim with Paypal, and they can go after your money, but it is a little more complicated. After that, it is basically the responsibility of the seller to deal with the PO to recover the item, or make a claim for insurance, not the buyer. I would file a claim with Paypal. If you paid by check or cash, you are screwed. Hence, NEVER pay with a check for ANYTHING online, unless you know the person.

I have had stuff lost in the mail from Ebay purchases. The last time that happened the seller was nice and offered me a refund, but he asked that I wait for him to process a claim with the PO to get the Stihl brush cutter blades that were lost. Evidently there is a center in Chicago or someplace in the midwest that a lot of lost stuff is sent to. He was able to get the parts found and sent to me in about a week. I do not know about Canada, and I have had a lot of issues with the PO in Canada when shipping there, and getting stuff from Canada shipped here. I have a policy to not buy or ship stuff to or from Canada as a result. I have had no problems shipping stuff to Australia though. I have shipped stuff to Ekka with no problem.

I'm no Ebay expert, rarely use it.

Sad to hear of this situation, I use Paypal for most my online transactions and they seem to help out (not that I ever needed it) however the people that are "verified" seem to care because an adverse Paypal issue is gonna bite you on the ass.

Our postal system is pretty fast and honest, like I wouldn't trust sending a parcel to say Afghanistan etc.

Hope it works out, and Windthrown did send me a beaut saw I still use today, sadly the MS440's have come to the end of the production line and when it dies I will be in a quandary what else to use to KILL PALMS!

Not to worry, I an buying up 440s and 044s on Craigslist. Loggers are broke now around these parts with the mills shutting down, and I am building up a small supply

Dang ripper mate!

Mine corrode out, the internals have been salavaged for other saws before, long thread at AS about it with a guy called snelling who got dudded on Ebay but I gave him the parts to get a fine 44 happening.

I love 44's.

Why?

The weight, power to weight and they're tough against palm corrosion, toughest of all saws. A Husky 372 was stuffed in under 3 months.

Echo's etc, might as well use a boat anchor to cut the tree! Lots of weight for crap power.

Anyway, mate, you just keep hording them 44's.

Now 46's, they're great too. Hey I just bought a new one, it'll never see a palm so it's safe for about 10 years. Why dont I use 46's on palms?

Simple, palms are basically a pole, so lots of blocking, and the power/weight ratio of the 44 is much nicer if you have lots to do.

Now the 441 weights pretty much the same as the 46 so why bother? And I dont like it, feels like some dicky powerband low cc but high speed motorbike, you know, got it all on paper but in the real deal sort of sucks.

Heh heh heh... I know Brian. He is pretty good with rebuilding and woods porting saws. The 044/440s are king of the beasts in the logging industry here. I had an arguement with a guy in AS just last week that said his 441 would spank my 044. I told him that if he could actually tell the difference between a 441 and a 440 for power, it was likely to be the other way around. On paper, the 441 has like, 1.8% more HP. He claims they did timed cuts and the 441 cut faster and consistantly. I said fine, come round and we can have a saw-off. Not going to happen I guess. He lives a long way from here.

I do not like the wide body, added weight or the spongey rocking-horse springey feel of the 441 either, but supposedly they have beefed up the springs now. Amusing that you trashed the 372XP so fast. They are next only after the 440 in the king of the beasts battle here in the logging areas. A lot of tree butchers here use 361s to climb with. A guy that I sub out climbing to (I quit climbing becasue of my back) uses the 361 for climbing after I let him use mine on a job. He loved it and bought one to replace his 360. He has half a dozen 200Ts and a few 440/460s for the groundies. I see the Mexicans with Echos all the time. TH CS3000s and CS306s and the like. Plastic crap. They run OK, but they are a pain to fix and they fall apart. I am not a huge fan of the baby homeowner Stihls either. They are made not to be fixed, and they have a lot of flaws. But they run.

I think you left it too late, to claim or open a dispute on Ebay you have to do it within 30 days of the transaction.
I have done it before and had money refunded.
You will have to track the items yourself now, legally, unless the seller is a real nice guy!
