Default Silver birch close to house.

Hi folks,
i live next door to a bit of woodland that is tended to by the county council when it suits them. i have many silver birch right next to my house. The previous owner took out one row. I want the council to come and remove them as they are extremely tall, sway in the wind and i am concerned that they will fall onto my house and my cars. They say i should pay for a tree surgeon to do it, but they are on their land. I am not a fan of destroying lovely trees but they are in real danger of ending up in my bedroom.

So who owns the land the trees are on, you, the council or some-one else?

Heritage harlet,
I would suggest to you that you contact a qualified Arborist from your region (or at least with experience negotiating the local rules and laws of your area) to provide you with a qualified assessment of the structural integrity of the trees you are concerned about.

Sean, if she isn't the owner of the tree why should she have to fork out for it?

What if the property is council owned, then they'd assess. We still haven't figured out who owns the land.

If it is privately owned she could write the owner a letter stating her concerns, and from that point on the owner is partially liable if no action is taken.

Can the arborist legally enter the property to assess anyway?

Here in Logan Council neighbours have the right to inform council of hazardous trees and council arrange inspection and works (either directly or via a contractor) .... I dont see a need for her to spend her dollars on a neighbours tree.
