Sorry that I have not posted further on this. You were both correct in your assessment of the difficulty.
Needless to say the Energy and Water Ombudsman (EWOV) ceased the investigation and therefore refused to address my concerns and claim for loss.

I need to add that EWOV is not a "court". And that they failed to notify me that their Arboriculturist actually made an adverse finding in my favour and that was he considered the prunning was bad and did not meet the Aust Standard! I don't know why they led me to believe that he was happy with the prunning (I found out his assessment after they closed the case). It seems they may have been reluctant to bite the hand that feeds them - and it seems to me that they act as Complaints Departments for the industries that funds them (not very independant at all despite their claims to the contrary).

I write again as it seems the electrical distribution company wants to prune again although trees have not growm much and have continued to die back and several actually have died.

As I got no joy with EWOV; I wanted them to stop excessive prunning and they didn't in the first instance; and they then would not level any compensation; I wonder if anyone has advice on how to seek compensation if this further prunning occurs.

I proposed this time to go to small claims tribunal to simply seek payment for the asset lost to me or the material (trees cut) taken from my property (presumably they will chip and takeaway to be sold as they did last time, denying me the use of that material for mulch or as firewood).

Is it still no legal representation in small claims? I think so, no lawyers so it'd be the way to go.

Bring along all your evidence, be methodical.

How are you valuing the trees? You might need some "offical" person to do it even if you use our free tool.
