without pictures we have very little chance of identifying anything for you. if in doubt get a qualified arborist in your area to inspect the tree and talk to your neighbour about the potential problem. there is a section in the yellow pages that has recognised qualified arborists make sure you talk to one of these not just any old name out of the book. you could try roller on here he is around your area approx.

thank i will take pic in the morning and post but to call someone out will cost me money wont it?,
im not paying for someone to come here to tell me whats wrong with next doors tree , the owner of the house does not live their but rents it out to students who dont look after any of the gardens back of front, their always over grown and i clear and cut enough of their over grown weeds that creep into my gardens twice if not 3 times a year as it is they also have bine weed totally covering everything in their garden and im fighting off my fences for last 7 years,

If there is a problem with the tree, once it has been brought to the owners attention they are liable and are required by law to sort the problem out, otherwise legally they dont have a leg to stand on, but start with a few detailed pictures of what you believe the problem is and we can go from there

Contact the real estate agent and have them deal with it, what council are you in? ... Some will come and assess but not BCC.
