My Neighbour (a renter not the owner) severely pruned two trees in my front yard. One tree (a palm) straddles the boundary line. As well as cutting everything on their side (I have no prob with this) they also entered my property to cut down all the fronds within reach. They have pruned at least 70%. The other tree (a large hibiscus) was also severely pruned about 50cm into my property. I have no problem with them cutting down anything on their side. They didn't ask me for permission. I have never even spoken about any trees with them. They entered my property without permission. What can I do? All the laws seem to assume that people won't act without permission? I feel my property has been damaged and violated! I plan to speak with them tomorrow. If they don't admit they are in the wrong and promise to not repeat, then what action can I take? Advice would be much appreciated! |

They are allowed to cut what is on there side of the boundary but cant enter you property with out permission, that is trespassing and is against the law! you are within your rights to have them charged but for the sake of peace you would be best to try and talk to them first and try and extract an apology and to make sure it wont happen again. remember that you have to live next to this person and its better to have good relations with your neighbors then have them spike your tyres!
