Default Lopping mature paper bark tree

Bought a house which has branches of a huge paper bark tree from next door property growing over the roof. In a storm recently one of the branches fell off the tree and (fortunately for me) fell into the yard of the next door property. I would therefore like to employ someone to lop the branches growing over my property and, of course, I would like to have it done properly to avoid future worry. Can you please advise the best process to have this done.

  1. Ring your council so you know your rights and whether or not the tree is protected
  2. Talk to your neighbour
  3. Get quotes for the work ensuring contractors are qualified arborists, and check that they are, preferably work should be to AS4373-2007 so a fenceline prune as the crow flies is unlikely

If all else fails you have the NSW Land and Environment Court (lucky you) with a specialist area for tree disputes.

Tree Dispute Information - Land & Environment Court : Lawlink NSW

Good luck, and I agree with you that you should be able to enjoy your property the way you like and no-one should think they have the right to intrude upon your property with their trees, flags, roofs, decks, antennas etc. Previous rulings in the court would likely be in your favour.

Also take some pictures NOW of the failed part and where it failed from, measure the diameter of the branch/wound etc .... data data and facts facts is what wins ... get them all, plenty of pictures.

All very good advice from Ekka, I would recomend a arborist report paying particular attention to where the main trunk divides into competing trunks, ( co -dominent trunks ).

This is where you find a lot of potentialy dangerous inculsions, I have seen many fail in this region. Hopefully your neigbour will understand your concern and allow this inspection to take place.

Good luck
