Default hakea tree help

Hi,

We have a Hakea tree in my background The tree is about 2 storeys tall and has large branches.

The issue is next door is building a house on a subdivision and on their property. The excavations have cut into the root system on their property. The issue is the tree sits 1 foot from the fence and I am worried this will be damaged as more excavating near the fence and our tree is needed.

An aborist working for the owner of the property has said this is OK and the council doesnt want to know.

It sounds as if the builders have chosen the arborist that suits thier needs, you would need evidence i.e. photos before and after, pictures of the roots cut, measurements ect but it doesnt sound good for the tree.

Start to document times, dates and events ... take many pictures as trees take years to die.

Likely the arborist is a fool and the developer a bugger one for hiring a fool.

Council likely doesn't care as the the Hakea is not protected.
If it is not protected then it's a civil dispute.

Here's another case similar, except the tree was protected.

Also, the arborist should know of the Australian Standard applicable to the damage inflicted.

If the arborist approved or recommended the damage then it's likely you have a case against his Professional Indemnity insurance as he has breached a standard.

If damage clains are under $7.5K you can persue without legals via small claims court or small debts court. But that's the last straw obviously, try to get some resolution out of court first.... like replacement planting or repair.

Load up some pictures for us please.
