Default Diseased Tree? (photos)

I have this tree in the back yard. It clearly has something wrong with it. The strangest thing is that while many of the older, larger branches are dead and will snap right off, there are smaller, live branches growing around them. What gives?

Sucker or water sprouting of new vigorous limbs around a trees trunk is indicative of a tree under stress or decline to senescence. Start thinking about removal and replacement options for your next spring. It looks like twas an Acer perhaps this maybe a nice spot for a fruit tree or two soon.

Looks like a lot of lichen on older stems - as Derwoodii said - tree is dying, and is making a last ditch effort with suckers. Take it out, and plant a different species, preferably from a different family.
