Thanks Ekka for getting back to me so quickly, unfortunately it's not what I wanted to hear. As I also live in Brisbane I'm sure the law applies to me, so it looks like the best action I can take is to move, even though the retaining wall is not a problem at the moment it's a hassle I don't want in the future.
